unique, custom content when baking a recipe

only unique, custom content created by a baker for the purpose of fulfilling the chosen recipe request may be submitted when baking a recipe. with recipes, the goal is to provide everyone with a way to request and drive the creation of new and exciting nsfw content. submitting stuff that already exists elsewhere on the internet goes against this goal. for more information on how to become a baker, as well as our baking guidelines, be sure to check out our baker information and how it works pages

prohibited content

while most are obvious for legal/ethical reasons, others are less obvious and exist due to restrictions placed by Visa/Mastercard. following these guidelines ensures payments can continue to be processed through our site, which in turn helps ensure recipes can continue to be fulfilled and bakers can be rewarded for their work

content is prohibited if it contains the following, in either real or animated form

- drugged/incapacitated
- rape, force, sleeping, intoxicated, hypnotized
- bestiality
- blood/mutilation
- pedophilia
- incest
- necrophilia
- hate crimes
- violence, or extreme sexual violence and/or pain
- child pornography (anyone under the age of 18)
- urination
- scat

prohibited behavior

in addition to not submitting prohibited content, the following behaviors are prohibited on heartpie

- gaming or manipulating the favoriting or bounty systems
- breaking heartpie or doing anything that interferes with normal use of heartpie
- creating multiple accounts to evade punishment or avoid restrictions

enforcement

we have a variety of ways of enforcing our rules, including, but not limited to

- asking you nicely to knock it off
- asking you less nicely
- temporary or permanent suspension of accounts
- removal of privileges from, or adding restrictions to, accounts
- removal of content

content ownership and license

by submitting content to heartpie, you represent and warrant that you are the original owner of said content or otherwise have the right to grant the license set forth in this section, and that such content does not violate the rights of any third party

you retain all rights and ownership in your content. heartpie does not claim any ownership rights in your content. even though we don’t claim ownership of your content, we do need certain licenses to your content in order to operate and enable the service. you hereby grant heartpie a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to exercise all copyright, publicity rights, and any other rights you have in your content for the sole purpose of operating, marketing, promoting, and improving our service

18 U.S.C. 2257 compliance statement

Users of the site who elect to become a Baker (each a "Performer") and produce visual depictions of actual sexually explicit conduct, simulated sexual content or otherwise, must first submit to the operators of the site a valid picture identification card, as defined in 28 C.F.R. 75.1(b), certifying they are over the age of eighteen. These records will be stored in a manner consistent with the format prescribed in 18 U.S.C. §2257, 2257A and 28 C.F.R. 75 (see below). Additionally, pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), materials deemed obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, are strictly prohibited and will be removed from the site. The owners and operators of the site are not the producers of any visual depictions of sexually explicit conduct.

Billing, Payment, and Refund Policy

For all purchases and payments for reimbursement costs, fees or expenses associated with a bounty or subscription, unless you have available account credits, Heartpie.com will charge your credit card according to the amount agreed upon between you and Heartpie.com for the use of the Service, and you hereby authorize us to charge your credit card for such amounts. Heartpie.com retains the right, in its sole discretion, to place a hold on any payment for Content.

Heartpie.com has no obligation to provide refunds or credits for payments already made to Bakers, but will fully investigate any disputes raised by Users and grant refunds or credits based on the outcome of the investigation.

Chargeback Policy

Heartpie.com strongly encourages all users to use the dispute resolution process, and/or contact us directly if you have any payment issues. All fees associated with a chargeback are covered by Heartpie.com. All chargebacks are fully investigated, and users who repeatedly initiate or receive chargebacks may have their account suspended

Privacy Policy

Heartpie.com collects personal information only if you voluntarily choose to share such information with Heartpie.com. You may browse the Site without disclosing any personal information. However, in order for you to take advantage of particular opportunities provided through the Service, we may require that you furnish personal information. When you register your account, sign up for newsletters, complete forms for optional programs, surveys, contests and other entries, and through communications transmitted through Heartpie.com, we collect information including your name, address, phone number and email address. You also may choose to send Heartpie.com personally identifying information in an email message containing information or inquiries about the Service.

Heartpie.com does not store any of your sensitive financial information on our servers. To perform financial payments, heartpie.com uses a PCI-compliant third party payment processor to handle all billing-related transactions.

By using the Service, you agree to letting Heartpie.com process and use the data obtained through usage of the Service. This processing and usage may include, but is not limited, to: providing our products and the Service, for billing, identification and authentication, and fraud prevention, to analyze Site usage and improve our products and the Service, to contact you and deliver administrative notices and communications relevant to your use our products and services, to enforce our Terms of Service, and to market the Service.
